Using eSignatures with The Letting Centre Forms and Agreements

Documents with eSignature merge codes

The following documents include eSignature merge codes ready to go, for you to use with Alto’s PropertyFile eSignature module:

However, for documents where the eSignature merge codes aren't already populated, you can always add them in manually. The merge codes are:

 Note

The following documents cannot and should not be eSigned:

  • G02 Form - Deed of Guarantee - Electronic signing of deeds is not advisable due to lack of certainty and safeguards with respect of the witness requirement, i.e. that the document has actually been signed in the presence of a witness. At present, it is unclear whether a deed can be validly executed using standard electronic signing systems

  • NTQ - Notice To Quit - This document can be eSigned by the landlord or the agent, but it may be more difficult to send this notice to the tenant for eSigning as it requires proof of receipt to support any possession claim which may be more difficult to prove with eSigning, i.e. proving that it was the tenant who actually received and viewed the notice

eSign FAQ's

  • What if I don’t choose the eSign option when finalising the document?

If you don't choose the eSign option, the merged document will simply include the name of the landlord, tenant or guarantor who needs to wet sign the document. If you don't want the name(s) to appear, you can delete them when finalising the document.

  • What about witness signatures?

Regardless of whether a document is being eSigned or wet signed, witness signatures are not a requirement on documents with eSignature merge codes. The exception to this is a tenancy agreement for a fixed term of more than three years that is created as a Deed in which case it cannot be eSigned.

PropertyFile does not enable you to obtain witness signatures using eSign. Therefore, when sending an agreement to be eSigned, you will need to remove the witness signature section when finalising the document.

  • What if I want the tenant to sign or initial at the bottom of each page of an agreement?

This is not required with a document that has been eSigned as the signed document cannot be edited.

  • What if I want to sign a document on behalf of a landlord?

Where a document can be signed by the landlord OR their agent, we have included the landlord eSign merge code. If you want to eSign the document on the landlord’s behalf, you can tick the Agent Signing? option when finalising the document.

  • I want to start using PropertyFile eSigning

All you need to do is activate eSigning in Alto.

Landlords, tenants and guarantors do NOT need a PropertyFile login to eSign a document

  • I don't want to use eSignatures

If the PropertyFile eSigning module is not enabled, the merged document will simply include the name of the landlord, tenant or guarantor who needs to wet sign the document. If you don't want the name(s) to appear, you can delete these details when finalising the document.

All you need to do is activate eSigning in Alto.
